The new UK "Highly Skilled" Tier would go into force in April 2011. The Highly Skilled Migrant Program (HSMP), formerly known as the Tier 1 General Visa, has been superseded by this new category of visa. Entrepreneurs, investors, and a select group of individuals who fall under the exceptional skill criteria would be able to enter the UK under the new Highly Skilled Tier Visa. The new Tier 1 immigration system will prioritise businesspeople and those with advanced degrees in science, the arts, and sports.

Therefore, starting in April 2011, the new Highly Skilled Tier Visa would only be available to a select group of entrepreneurs, investors, and skilled talent who could travel to the UK.



The United Kingdom Government has unveiled new proposed immigration changes.

The UK government has provided clarification on the much expected and anticipated reforms to the immigration system in the UK. A permanent immigration cap on skilled immigrants, a new exceptional talent visa, and new requirements for skilled workers with a job offer and intra-company transfers are among the changes that occurred in April 2011, according to The UK Border Agency (UKBA). Moreover, there would be notable modifications to the regulations pertaining to the sponsorship of non-EU employees.

It was proposed that a new "Exceptional Talent" visa would replace the Tier 1 General Skilled Immigration Visa, which would expire on April 6, 2011. The UKBA declared that, as of April 6, 2011, the "exceptional talent" visa category would have an annual cap of 1,000 visas, while the Tier 2 visa category would have an annual cap of 20,700 visas.

To provide more clarification, the UKBA said that the 1,500 seats available for Tier 2 visas will be split into 12 monthly quotas. Additionally, the certificate of sponsorship must be handed to the potential employer within three months of the company receiving it. The recently implemented regulations stipulate that businesses must submit an application to the UKBA for a certificate of sponsorship pertaining to a particular position. At the moment, sponsorship certificates are distributed once a year.

All non-EU workers who are employed in graduate-level positions in the UK, speak English at an intermediate level, and satisfy specific employment and pay conditions are eligible for the Tier 2 visa.

A few modifications to the Tier 2 visa intra-company transfer process are also anticipated, such as the need that candidates seeking for this type of visa have a position on the graduate occupation list. In the event that the worker plans to remain in the UK for a longer period of time, he must also hold a job that earns more than £40,000 annually. Workers making more than £40,000 per year are eligible for a three-year visa with the option to extend it for an additional two years.

The number of employees who can join the UK via the intra-company transfer route for Tier 2 visas, however, is uncapped.
